Villa Encanta (hereinafter “Villa Encanta”) to the customer by providing Villa Encanta, including accessories: (Villa Encanta – 4 bedrooms, 4 bathrooms, living room, kitchen; Garden House – 1 bedroom, 1 bathroom, living room, kitchen; terrace, swimming pool, garden). The customer, on the basis of his interest, orders this accommodation and agrees to pay the agreed price. The accommodation contract is concluded upon confirmation of the customer’s order. Account number for payments in EUR: CZ04 2700 0000 0021 0869 8243 SWIFT BACXCZPP Variable symbol: date of stay e.g. 12.6-18.6.2023= 1261862023 Maximum capacity of the object: 10+2 persons. In case of exceeding the maximum capacity during the stay, the accommodation provider is entitled to unilaterally terminate the accommodation contract without any financial compensation. Additional services included in the price: bed linen and towels, coffee and tea, wifi, parking. Other according to www.villaencanta.es. II.Price of accommodation The provider of accommodation and the customer have agreed on the price of accommodation for providing Villa Encanta to accommodation for period of time agreed upon in the order, including VAT. The customer shall pay the price of accommodation in this way: Advance payment of 30% of the price, within 3 days of the conclusion of the accommodation contract. Additional payment of 70% of the price, within 60 days prior to the date of accommodation. In the event of delay in payment of any part of the price, the accommodation provider is entitled to charge contractual interest on late payment of 0.1% of the amount due for each day of delay. If the deposit is not paid even within 3 days after the agreed date, then this contract shall terminate. In the event of a delay of more than 3 days in the payment of the price, the accommodation provider is entitled to withdraw from the accommodation contract. III.Cancellation fees The customer is entitled to withdraw from the accommodation contract only if he/she pays the accommodation provider a cancellation fee in the agreed amount: -in case of withdrawal more than 60 days before the start of the accommodation, the cancellation fee is 30% of the agreed accommodation price -in case of cancellation 60 days or less before the start of the accommodation, the cancellation fee is 100% of the agreed accommodation price The accommodation provider is entitled to offset the deposit or additional payment against the cancellation fee. IV.Other Arrangements The customer is obliged to pay the accommodation provider in advance, no later than 6 days before the date of accommodation, a deposit in the amount of CZK 15.000 / EUR 500 to cover damage caused to the property of the accommodation provider, which will be then returned to the client by transfer to the account. The accommodation provider is entitled to satisfy his claims for damages caused during the accommodation from this amount. In this case will the provider of accommodation return to the customer the amount reduced by these claims for damages. The customer is obliged to ensure that the damage to the property of the accommodation provider is not caused and that public order is not disturbed. The customer is obliged to vacate Villa Encanta on the day of the end of the accommodation and to hand over the vacated Villa Encanta to the accommodation provider. Villa Encanta is used exclusively for recreational purposes. Any other activities (e.g. business activities, filming of images and audio-visual recordings with sexual themes, drug themes, violence, etc.) are strictly prohibited. In the event of a violation of this prohibition, the client is obliged to pay the accommodation provider a contractual penalty of CZK 125.000 / EUR 5.000 and the accommodation provider is entitled to immediately terminate the accommodation contract without notice and thus terminate the client’s stay without any financial compensation. The accommodation provider is entitled to satisfy the claim for the contractual penalty from the deposit paid. In the event of exceeding the maximum capacity of the property during the stay, the accommodation provider is entitled to immediately terminate the accommodation contract without notice and terminate the client’s stay without any financial compensation.
